This is the last Will and Testament of me Mary Deakin of Woodcote in the Parish of Bromsgrove in the County of Worcester Widow First all my just funeral and testamentary expenses and the costs and charges of proving this my will and ??? ??? ??? to be fully paid and satisfied. I give and bequeath unto my dear son Robert Deakin the sum of one thousand pounds absolutely and ??? ?? that any amounts which may at the time of my decease be existing? between my said son Robert and myself shall not be enquired into by my executors but that the same may be to all intents and purposes be considered? as settled and at an end I give an bequeath unto my said son Robert Deakin and my dear son John Bickerton Deakin their executors administrators and assigns all the rest and residue of my ready? money ??? fore money and all other my personal estate and effects whatsoever and wheresoever upon trust to lay out and invest the same in ?? or ??? of my said ??? to the survivor of them or the trustee or trustees for that time being this my will ?? and upon ?? of the parliamentary stocks or public funds of Great Britain or at interest upon government or real securities in England but not in Ireland with full power for the trustee or trustees for the time being of this my will to alter and vary the said stocks funds and securities for others of a like or of that ??? aforesaid when and as often as they hall think proper and so and shall pay the interest dividends and annual profit of the said last ???? trust monies stocks funds and securities unto or per,it the same to be ???? by my son the said John Bickerton Deakin for and during the time of his natural life subject nevertheless to the proviso hereinafter mentioned and from and after his decease Then as the principal of that same trust monies and the stocks funds and securities in or upon which the same shall be invested or ??? out as aforesaid (except as to the sum of five hundred pounds part thereof hereinafter given to my grandson Bickerton Homer Deakin and the like sum of five hundred pounds hereinafter given to my grand daughter Mary Lucy Deakin) upon trust and I give and bequeath the same unto such of the children or ??? ...... published this sixth day of one thousand eight hundred and fifty one Mary Deakin

ROBERT DEAKIN the younger of WOODCOTE in the parish of BROMSGROVE in the county of WORCESTER, farmer being of sensible and disposing mind all my Messuage Cottage Farme lands and hereditaments at Woodcote in the parish of Bromsgrove and Upton Warren in the county of Worcester aforesaid and all other my real estate I give and devise to my loving brothers ADDISON DEAKIN and ISAIAH DEAKIN and my respected neighbor and friend FRANCIS BAGNALL of the Moors in the parish of Upton Warren Farmer, whom I make my Executors – upon to carry on my farming business or to set and let the same premises or any part thereof and out of the rents etc., pay my wife Mary the annuity of £150 per annum for her life and to pay from residue of the rents etc so much as they shall think fit in the support and education of my children during their minority or in placing them out apprentice and in the maintenance and support of my eldest son until he arrive at the age of twenty one years. And upon further trust by sale or Mortgage to raise the following sums for my younger children – If but one £3000 if more than one £2000 each to be paid at their respective ages of one and twenty years with interest at the rate of 5% and subject thereto I give and devise all my said Messuages etc., to my eldest son and his heirs for ever. If I have no son or the issue of a deceased son then I give and devise all my said estate unto all and every my daughters and their heirs. My wife shall have the use of the best parlour and chamber over it with all the furniture of the same in my present dwelling house. I give to my said executors ally my farming stock, personal estate and effects upon Trust to take an inventory and valuation thereof and after payment of my debts, etc, to replace and continue the monies arising therefrom and what shall not be wanted for carrying on my farming business out at an interest and such interest to accumulate in increase of the residue of my personal estate until my eldest son shall attain his age of twenty and one years. And then upon trust from and out of the residue of my said personal estate to pay the following sums of money unto my younger children viz if more than one such younger child £1000 each at twenty one years of age with interest at 5% subject thereto I give all the residue of my farming stock personal estate and effects unto my eldest son then living and in case of my having no son nor issue of a deceased son then to my daughters equally.

I appoint my said brothers Addison Deakin and Isaiah Deakin and the said Francis Bagnall with my wife guardians to my children during their minority. In case of the death of all my children and without issue I give all my said messuage etc, unto my brothers (four) Addison, Thomas Isaiah and James.

Whereas by my will I have directed my executors out of the residue of my estate to pay unto my younger children if but one £2000 and if more than one £1000. Now in case I shall have but one such younger child I revoke the said legacy of £2000 and direct my executors to pay only £1000 to such younger child.
